Some charities are also Social Enterprises. Having charitable status has tax advantages,
however, there are regulatory constraints.
Charities are organisations that benefit the public and whereby all
profits are re-invested back into serving the charitable aims of the
organisation. To register your organisation as a charity you will need to make a formal
application to The Charity Commission.
To help you to provide all of the information that is needed, they have issued a Registration Application Pack (the Pack). It contains an
application form; a trustee declaration form; and a copy of their advice on the
responsibilities of trustees.
The application form includes notes and asks
applicants to provide as much information about their organisation as possible.
This will reduce the need for the Charity Commission to ask you for further details about what your
organisation will do or how it will be run. Also included in the pack is some
information about their "gateway" approach to applications.
If you are applying to register a charitable company which will
take over the work of an existing registered charity (often referred to as
incorporating the existing charity) you should use the specially prepared
Incorporation pack and not the Application pack.
